Icoste.com (“Icoste”, the “Site”) aims to deliver the best experience to our users for shopping and price comparison purposes.  You may only use the site according to following terms and conditions, which you agree to accept by your use of the Site.  Icoste reserves the right to modify or revise these Terms of Use and/or Privacy Statement or other policies at its sole discretion.  Any modifications shall be effective within 7 days of being posted on the Site. You are bound by such modifications or revisions and should therefore review the terms frequently.  Any continued use following such changes or modifications to the Terms of Use and/or Privacy Statement constitutes your acceptance of these changes or modifications, and should you not agree to any of the changes or modifications to the Terms of Use and/or Privacy Statement, please do not continue to use the Site.

LICENSE AND SITE ACCESS

Icoste grants you a license to access and use the Site for personal, non-commercial purposes, other than to purchase or sell items through the Site's Service, or to purchase items from third-party merchants linked to the Site. This license prohibits any resale of the Site or its contents; any collection and use of any product listings, descriptions, or prices other than as expressly authorized herein; any derivative use of the Site or its contents. Any unauthorized use shall immediately terminate the license granted by Icoste, and may subject you to civil and/or criminal prosecution. You are granted a limited, revocable, and non-exclusive right to create a hyperlink to any page of the Site so long as the link does not portray Icoste, its subsidiaries, co-brand partners and other partners or its or their respective services in a false, misleading, derogatory or otherwise offensive matter. You may not use any Icoste licensor, subsidiary, affiliate, co-brand partner, or other partner logo or other proprietary graphic or trademark as part of a link to the Site without first obtaining the express written consent of Icoste.

CONTENT AND INFORMATION COLLECTION

Icoste is not designed or intended for use by children under age of 13, although participating merchants on our site may offer children's products for purchase by adults. Icoste collects and uses visitor information in accordance with our Privacy Policy. We do not knowingly collect personal information from children under 13 years of age. If you are under age of 18, you should use Icoste only with involvement of a parent or guardian. Children under age of 13 may not submit any personally identifiable information to us, and if we discover that we have inadvertently gathered any such information from a child under age of 13, we will take appropriate steps to delete it.

Icoste is only a venue. Icoste acts as an online marketplace and price comparison shopping tool, which provides a number of different services to assist you in comparison shopping for products on the Site.  Icoste provides information regarding products and third-party merchants, links to third-party merchants that are selling listed products, and hosts storefronts for third-parties to list and sell products. Icoste is paid by merchants or third parties for listing products on the Site, for showcasing featured merchants and or products.  The products listed on the Site are sold by third party merchants, and are not sold by Icoste directly.

REVIEWS AND RATINGS

You may submit product reviews/ratings and store reviews/ratings. These reviews/ratings are informative for those wishing to use them, but they do not guarantee any level of performance by an online merchant or other third party in any given transaction. Icoste shall have the right, but not the obligation, to monitor the content of the Site and to exclude or remove any material that is deemed at its sole discretion to be inappropriate according to the above standards or otherwise objectionable, or to expose it to potential liability from third parties.

Icoste does not warrant that product descriptions, pricing, editorial commentary or any other content of the Site or in the Storefronts section of the Site, regardless of its source, is accurate, complete, reliable, current or error-free. Site content is provided for informational purposes only and does not constitute an endorsement by Icoste of any product, merchant, seller, or service. You should not rely on such information in situations where its inaccuracy would cause you to suffer any loss (see Disclaimer of Warranty and Limitation of Liability). Icoste assumes no liability for inaccuracy or incompleteness in its search results, editorial content, user ratings (store or product related) or other content on the Site.

The Site’s other services may include links to other sites on the Internet that are owned and operated by online merchants, survey incentive vendors, and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the site administrator or Webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is subject to the terms of use and privacy policies of each site, and we are not responsible therefore.

INDEMNITY

You agree to defend, indemnify and hold Icoste, its subsidiaries, affiliates, co-brand partners or other partners, and their respective officers, directors, employees and agents free and harmless from and against any claims, actions and demands, including, without limitation, any legal and accounting fees resulting from your use of the Site or your breach of these Terms of Use and Privacy Statement. Icoste shall provide notice to you promptly of any such claim, suit or proceeding.

YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT USER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN 'AS IS' BASIS. ICOSTE AND ICOSTE AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. NOTWITHSTANDING ANYTHING TO THE CONTRARY, ICOSTE AND ICOSTE PARTNERS MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DO ICOSTE OR ICOSTE PARTNERS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE, AS TO CONFIDENTIALITY OR PRIVACY OF ANY OF USER'S INFORMATION, OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. REFUNDS & RETURNS FOR MERCHANTS
